The short version
- 4sum keeps score for friendly side games. It does not take bets, hold money or move money.
- 4sum Pro is an optional subscription that renews automatically until you cancel it in your App Store or Google Play settings.
- Clips you send to Player of the Week stay yours; you let us post them if we pick them.
- Be decent: don’t misuse shared rounds or send anything you don’t have the right to send.
The licence
We give you a personal, non-exclusive, non-transferable, revocable licence to use 4sum on devices you own or control, for your own non-commercial use, under these terms and the usage rules of the store you got it from. You may not copy, modify, reverse-engineer, resell or redistribute the app, except where the law allows it regardless of these terms.
What 4sum is, and is not
4sum is a scorekeeper for friendly wagers between people who already play golf together. It works out who owes whom; it does not process payments, hold funds, take a cut, or offer gambling of any kind. Any money that changes hands is between you and your friends. You are responsible for following the laws where you play.
Distances, course data, handicaps and game results are worked out as carefully as we can, but they can be wrong. Course data comes partly from OpenStreetMap contributors and other public sources. Check anything that matters before you rely on it.
Accounts
An account is optional for the free parts of 4sum and needed for Pro features that use our servers. You must be 13 or older to make one. Keep access to your email address secure, since that is how you sign in. You can delete your account at any time in the app (Settings → Account) or at 4sum.twobeersstudios.com/delete-account. Deleting an account does not cancel a subscription; cancel that in your store settings.
4sum Pro subscriptions
4sum Pro adds hosting group rounds, recording and editing shot clips, detailed over/under lines, custom games, cloud backup and Player of the Week. Scoring, every built-in game, settling up, GPS and joining other people’s group rounds stay in the free version.
- Plans and price. Monthly or yearly. The current price is shown in the app before you buy (in the US, $2.99 a month or $25 a year at launch) and is charged in your local currency by Apple or Google.
- Automatic renewal. Payment is charged to your Apple ID or Google account when you confirm the purchase. The subscription renews automatically for the same period and price unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
- Managing and cancelling. Manage or cancel in your App Store account settings (iPhone) or Google Play → Payments & subscriptions (Android). Cancelling stops the next renewal; Pro stays on until the end of the period you paid for.
- Offers and codes. Introductory prices, founder pricing and offer codes are described where they are offered. A free or reduced period renews at the regular price unless you cancel before it ends. Codes are redeemed through Apple or Google, not through us.
- Refunds. Purchases are handled by Apple or Google, and refunds follow their policies. Ask Apple at reportaproblem.apple.com, or Google through Google Play.
- Changes. If we change the price, the store tells you in advance as its rules require, and you can cancel before it applies. We may add, change or retire Pro features over time; we will not take away the main thing you subscribed for during a period you have paid for.
Your content
Rounds, players, courses, clips and custom games you make are yours. When you use a feature that sends them to our servers (a shared round, a hosted tournament, shared course maps, cloud backup or Player of the Week), you give us the permission we need to store and show them for that feature, as the privacy policy describes.
Custom games you build are saved for you alone; 4sum does not publish or share them with other users.
Player of the Week. Taking part is optional and only for Pro subscribers who turn it on. When you send a clip you confirm you filmed it, that you have the right to send it, and that anyone you can recognise in it agreed. You let Two Beers Studios use, edit, post and share that clip in 4sum’s social channels and marketing, worldwide and without payment beyond any prize. You can withdraw a clip in the app before it is picked. The full official rules, including prizes and how winners are chosen, are in the app under Settings → Pro → Player of the Week, and form part of these terms. Apple and Google are not sponsors of Player of the Week and are not involved in it in any way.
Fair use
Do not use 4sum to:
- send anything illegal, hateful, sexual, violent or that you don’t have the right to share;
- film people who have not agreed to it;
- break into, overload or scrape our servers, or get around Pro or other limits;
- impersonate someone or put someone else’s details into a shared round without their say.
We may remove content, and suspend or close an account, that breaks these terms. If that happens to a paid account for a reason other than a breach of these terms, we will help you get a refund through the store.
Apple
If you got 4sum from Apple’s App Store:
- These terms are between you and us only, not Apple. We, not Apple, are solely responsible for 4sum and its content.
- Your licence is limited to using 4sum on Apple-branded products you own or control, as the App Store usage rules allow (Family Sharing included where it is enabled).
- Apple has no obligation to provide maintenance or support for 4sum.
- If 4sum fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation for 4sum, and any other claims, losses or costs from such a failure are ours to deal with.
- We, not Apple, are responsible for any claims by you or a third party relating to 4sum or your use of it, including product liability claims, claims that it fails to meet a legal or regulatory requirement, and consumer protection, privacy or similar claims.
- If a third party claims that 4sum or your use of it infringes their intellectual property, we, not Apple, are responsible for investigating, defending, settling and discharging that claim.
- You confirm you are not in a country subject to a US Government embargo or designated a “terrorist supporting” country, and are not on any US Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and, once you accept them, may enforce them against you.
Questions, complaints or claims about 4sum go to us at the address below.
Disclaimers and liability
4sum is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement, and we do not promise the app or our servers will always be available or error-free.
To the extent the law allows, we are not liable for indirect, incidental, special or consequential losses, or for lost data, money or bets, and our total liability to you for any claim is limited to what you paid us for 4sum in the 12 months before the claim, or US$50 if that is more. Nothing here limits rights you have under consumer law that cannot be limited.
Ending this agreement
You can stop at any time by deleting the app and, if you have one, your account. These terms end automatically if you break them. The parts about your content licence for clips already picked, disclaimers, liability and governing law survive.
Governing law
These terms are governed by the laws of the State of Illinois, USA, without regard to its conflict of law rules. Where you are a consumer living elsewhere, you keep the protection of the mandatory laws of your home country.
Changes to these terms
We may update these terms as 4sum changes. The effective date above shows the latest version. If a change matters, we will tell you in the app before it applies. Continuing to use 4sum after that means you accept the updated terms.
